As Baby Boomers And Their Parents Age, Law Firms Prepare For Increase In Nursing Home Negligence Cases

Lawfirms are preparing for an increase in negligence lawsuits filed by the Baby Boom generation on behalf of their aging parents. Within ten to fifteen years, the lawfirms anticipate some older Baby Boomers will themselves be in nursing homes, and will be the plaintiffs in their own law suits.

The parents of Baby Boomers are now filling nursing homes in record numbers. According to the 1997 National Nursing Home Survey, there were 1,465,000 residents 65 and older in nursing homes. The survey noted that in 1997, about 75 percent of all nursing home residents 65 and older required assistance in three or more activities of daily living, including bathing, dressing, eating, transferring from bed to chair, and using the toilet. About 42 percent of nursing home residents were diagnosed with dementia, and 12 percent had other psychiatric conditions, such as schizophrenia and mood disorders. In the intervening seven years, these numbers have only swelled.

Baby Boomers must now contend with the treatment their elderly parents receive if they are placed in nursing homes or other care facilities. Incidences of neglect, negligence, and abuse are on the rise.

Dementia

Definition:
A clinical term used to describe a group of brain disorders that disrupt and impair cognitive functions -- thinking, memory, judgment -- personality, mood, and social interaction. Also, see Senility in this Glossary.

Congregate Meals

Definition:
Nutritious meals provided at least five days a week in local Senior Citizen Centers throughout the State. Meals are usually served around noon, and in some areas meals may be available at other times of the day. Besides providing nutrition, congregate meals provide needed socialization for older adults.

Care/Case Management

Definition:
Care management is the process through which needs are identified and managed to allow the consumer to receive service in the most appropriate, least restrictive setting. This process focuses on consumer need and includes: development of a care plan addressing consumer need; explaining options for service delivery; ongoing monitoring of service delivery; periodically reassessing the consumer condition; making the necessary adjustments to the care plan; and notification to providers of changes in service provision.
